The 2nd has been opened too. $168 is too much to pay for open box. Has anyone else experienced this?** A: This just happened to me, the box was damaged and was for sure opened prior to me. If the stylized Nespresso logo is on the machine somewhere you can be pretty sure you are getting an officially licensed machine. While Nespresso's patents began to expire in 2012, Nestlé has continued to work hard to discourage competitors from making a machine compatible with the original pods.
